PURCHASE AGREEMENT

This agreement was entered into on ______________________ between the parties CATHERINE and ROBERT ROH, also known as RA-CA DANES (SELLER) and _________________________________________________________ (BUYER).

The purpose of this agreement is to outline and define the cost, delivery, guarantee and/or spay/neuter of Great Dane puppy purchased directly from RA-CA DANES.

Per AMERICAN KENNEL CLUB (AKC) Regulations for Record Keeping and Identification of Dogs, the below information is correct for the contract pertaining to this specific Great Dane puppy.

BUYERS deposit of _________________ for the purpose of purchasing puppy is non-refundable if BUYER fails to complete transaction.
BUYERS unpaid balance of ________________ will be paid in full before puppy is removed from RA-CA DANES.
BUYER acknowledges that the above purchase price is for puppy only. BUYER further agrees that any additional costs related to the shipping crate, health certificate and all shipping/transportation required for puppies final destination, must be paid in advance by BUYER. In the event RA-CA DANES holds puppy for BUYER after eight (8) weeks of age, BUYER is solely responsible for any Veterinary charges accrued during puppies stay until delivery to BUYER. Deposit money will be applied to Veterinary bills and balance of total purchase price owed to be adjusted. After twelve (12) weeks of age a boarding fee will be assessed at twenty-five dollars ($25.00) a day.
All deposit/purchase monies shall be refunded, (minus any Veterinary/boarding costs accrued) to BUYER if SELLER fails to complete transaction.

BUYER will take puppy to a Veterinarian of choice for a health assessment by two (2) weeks of ownership and provide a full report, Veterinarians name and phone number to RA-CA DANES. The assessment to include baseline CBC, urinalysis and stool check. BUYER gives SELLER authorization to speak with family Veterinarian at any time regarding any health issues with puppy/dog purchased from RA-CA DANES. SELLERS puppy guarantee covers a congenital “total body systems” approach. The following were compiled from “THE MERCK VETERINARY MANUAL” (eighth edition) and are the ONLY disorders covered in this guarantee.

CARDIAC: Atrial/Ventricular Septal defects, Patent Ductus Arteriosus, Persistant Right Aortic Arch, Pulmonic/Subaortic Stenosis, Tetralogy of Fallot, and Mitral/Tricuspid Valve Dysplasia.
HEMATOPOIETIC: Lymphoma, Lymphosarcoma and Lymphocytic Leukemia. Coagulation Protein Disorders: Factor I, II, VII, VIII, IX, XI, XII, Prekallikrein Deficiency, Canine/Thrombasthenic Thrombopathia, Von Willebrands Disease and Cutaneous Vascular Disease.
DIGESTIVE: Congenital Megaesophagus, Vascular Ring Entrapment Anomalies, Crisopharyngeal Achalasia, Esophageal Diverticula, Portosystemic Vascular Shunt, and Malignant Oral/Gastrointestinal Neoplasms.
OPHTHALMOLOGY: Glaucoma, Congenital/Juvenile Cataracts, and Progressive Retinal Atrophy.
ENDOCRINE: Exocrine Pancreatic Insufficiency, and Pancreatic Neoplasms, Glycogen Storage Disease, Hyper/Hypoadrenocorticism, Functional Islet Cell Tumor, Juvenile-Onset Panhypopituitarism, Diabetes Insipidus/Mellitus, and Hypothyroidism.
MUSCULOSKELETAL: Patellar Luxation, Elbow Dysplasia, Hip Dysplasia (scoring OFA moderate to severe) and Neoplastic Arthritis.
NERVOUS: Cerebellar Abiotrophies, Congenital Hypomyelination, Spinal Muscular Atrophy, Wobblers Syndrome, Spinal Dysraphism or Myelodysplasia, Congenital Vestibular Disease, Spina Bifida, Degenerative Myelopathy, and Malignant Brain/Spinal Cord Tumors.
RESPIRATORY: Metastatic Tumors of the Lungs.
URINARY: Renal Dysplasia/Hypoplasia, Unilateral Renal Agenesis, Polycystic Kidneys, Ectopic Ureter, Urachal Remnants, Hypospadias, Urethrorectal Fistulas, Fanconi Syndrome, and Malignant Tumors of the Kidneys.

All the above must be diagnosed by one (1) year of age. The disease must be severe enough to preclude the animal from leading a healthy life after corrective actions are performed by the BUYER through surgery, diet change and/or medication and providing that all the above has not been caused by abuse/neglect and/or lack of care on the BUYERS part. A written Veterinarian report, along with complete Veterinary records and a full/total body necropsy must be performed at BUYERS expense and will be sent to SELLER as proof of any of the above said disease/defect before the dog reaches one (1) year of age. SELLER must be notified in writing of any disease and/or defect before ANY action is taken by BUYER. Hip dysplasia is covered for the life of the dog. Hips must be scored moderate to severe with Orthopedic Foundation for Animals (OFA) and dysplasia must prevent the dog from leading a healthy/pain free life after corrective actions are performed through surgery and/or medical treatment. OFA results, a written Veterinarian report, along with full Veterinary records must be submitted to SELLER as proof of said defect. SELLER will not cover ANY other disease/defect/illness/issue whether congenital/hereditary/acquired not listed specifically in item six (6) of contract.
This guarantee entitles BUYER to a puppy of equal dollar value from future litters if any of the defects occur listed in item six (6). Puppy selection to be determined by RA-CA DANES. Coloration may not be the same as the original puppy. BUYER must pay any shipping crate, health certificate, and all shipping/transportation required to obtain the replacement puppy.

SELLER guarantees this puppy is in fact purebred and will provide an AKC registration card to BUYER when terms of agreement have been met. SELLER will also provide pedigrees on both sire/dam. Both parties acknowledge that said puppy will be spayed/neutered and proof of said spay/neuter must be sent to RA-CA DANES by 1 year of age. RA-CA DANES will retain ownership of said puppy until Veterinary proof of spay/neuter is sent to SELLER, SELLER will then send BUYER the puppy’s AKC registration card marked as LIMITED and transfer ownership to BUYER. If puppy sold without spay/neuter clause FULL registration will be given to BUYER. The prefix RA-CA’S will be placed on all animals with full registration

This guarantee is for one (1) year. It becomes null and void and the BUYER is not entitled to ANY refund in the event BUYER fails to provide SELLER with all records identified in items five (5) and seven (7) of this contract. If the puppy has been bred, abused and/or neglected medically or physically, euthanized, returned sick and/or dying except from diseases listed in item six (6) or if puppy was sold on FULL registration and was spayed/neutered without consent from SELLER.

In the event BUYER does not want the puppy/dog for any reason, BUYER must return puppy/dog to RA-CA DANES. Up to seven (7) days after being removed from RA-CA DANES, SELLER will reimburse fifty per cent (50%) of purchase price to BUYER. From seven (7) days to fourteen (14) days SELLER will reimburse twenty-five per cent (25%) of purchase price to BUYER. After fourteen (14) days there will be NO reimbursement. RA-CA DANES will not reimburse ANY money to BUYER at ANY time from the date of this contract if puppy/dog is returned abused and/or neglected, sick and/or dying, except from any diseases listed in item six (6) has been euthanized without agreement from SELLER, stolen, lost, impounded or without the AKC registration card. BUYER will transfer ownership to RA-CA DANES in the event puppy/dog has already been registered by BUYER. BUYER is not authorized at ANY time to take a RA-CA Dane to an animal shelter, pound, rescue group or third party. RA-CA DANES will serve as rescue for any dogs of their breeding.. RA-CA DANES reserves First Rights of Refusal if BUYER wishes to place puppy/dog with a third party. All third parties must be agreed upon by SELLER.
Any shipping crate, health certificate, and all shipping/transportation costs involved in returning puppy/dog to RA-CA DANES will be solely BUYERS responsibility.

Both parties recognize Callaway in St. Mary’s County, Maryland as the place where this agreement was entered into and acknowledge the courts of St Mary’s County as the courts jurisdiction should and disputes arise from this agreement.

If BUYER breaches this contract then BUYER is said to be in default. If BUYER defaults on this agreement then BUYER agrees to return said puppy/dog without any reimbursements and pay an additional one thousand five hundred dollars ($1,500.00) plus all court costs, fees, and any costs incurred by the SELLER in obtaining puppy plus attorney fees not exceeding twenty per cent (20%) of the total judgment against BUYER.

BUYER was able to view in person ALL animals at SELLERS home. A physical exam was performed by both parties of the kennel grounds. All animals had clean water, food, and shelter with minimal to no feces present. No animal appeared ill, and all were in good weight with no sores present, no nasal drainage or coughs. If requested, BUYER was able to greet each animal and temperament was found superior. A tour of the “puppy room” and “juvenile room” was performed by both parties. Floors were clean with no odors. Puppies had futon beds or thick floor mats for bedding, along with clean water and ample toys. Juvenile puppies had access to the outdoors.

The above named parties haveread and understood the terms of this agreement and have signed their names below in acknowledgment.

ADDENDUM #1

This addendum covers the feeding instructions for your RA-CA DANE puppy.

The following foods are acceptable to feed your puppy. Beaver Dam (Skippers Choice), Alpo (Beef/Chicken, Lamb and Rice or Come and Get It), Pedigree (Adult) or Dog Chow (Adult). If any other foods are feed, RA-CA DANES is NOT responsible for any negative effects puppy/dog will develop at a later age.
BUYER acknowledges SELLER has explained/demonstrated in detail the importance of adhering to this diet and everything that is covered in this addendum.
That certain lines of dogs do better with one product than others and the breeder knows best what foods work with their dogs.
That RA-CA DANES is on their 7th plus generation of their Danes and knows what they do well on.
Has explained in detail what Hypertropic Osteodystrophy (HOD) is.
How HOD is directly related to diet.
Has explained and demonstrated HOD starts distal in the joints, it does not occur overnight and what the early warning signs are such as splayed toes, down on the pasturns, warm growth plates, and pain to joints.
Has been instructed to observe the puppies feet everyday, noting any changes in structure and has been instructed to send photo’s of the feet/legs of the puppy if there is ever a question so breeder can assess issue and possible diet change.
That their RA-CA puppy will NOT do well on any food with a protein level above twenty-one percent (21%).
Is aware that puppy may need to be switched to a food that has a lower protein level than twenty-one percent (21%).
That puppy went home on one of the above listed brands of dog food and was free of HOD or any diet related issues at the time of purchase.
That the majority of supplements are harmful to the rapid growing puppy and the only approved supplements are glucosamine/chondroitin.
That the puppy may develop allergies, irritable bowel disorders, coat issues, appetite changes and growth issues if diet is changed.
That BUYER will not be influenced by the internet or their Veterinarian to change the diet of their RA-CA puppy. That once a puppy develops severe HOD, there may be permanent skeletal damage or even death.
